Kevin has 43 years experience in civil litigation, concentrating in financial and fiduciary litigation. His trial and appellate cases have involved banking, bankruptcy, will contests, trust mismanagement, contracts, director and officer liability, class action defense, shareholder disputes, equine disputes, securities fraud, representation of Ponzi scheme victims, lawyer and accountant malpractice, and insurance coverage disputes.

Kevin has served as counsel to business owners, non-profit organizations, and governmental entities. He also does trust and estate planning and probate, large and small.

Areas of Practice

  • Represented creditors in several prominent bankruptcy cases such as the Calumet Farm Trophy litigation, the Lew Perrin McGee Ponzi scheme bankruptcy, the Zayat Stables Chapter 11 case, the Pacer Health Management bankruptcy (Knox County Hospital), and many coal company cases.

    Obtained critical vendor settlements in major Chapter 11 cases in NY, VA and KY.

    Defended or settled numerous bankruptcy preference avoidance actions.

    Successfully defended (a) the City of Frankfort and its planning staff, and (b) the Lexington-Fayette Urban County Airport Board in important published cases clarifying the governmental immunity of municipal planning and sewer functions, and county boards and affiliated corporations.

    Advised a Division I university athletics department on the largest multimedia-rights contract of its kind.

    Successfully defended antitrust litigation concerning Division I intercollegiate sports, and simulcast wagering on horse racing.

    Won summary judgment for a major retailer in a $1.5 million build-to-suit lease dispute, and recovered attorneys’ fees in the full amount expended by the client.

    Legal advisor to several large family businesses including automobile dealerships, for 30 years.

    Represented beneficiaries of several of the largest trusts in Lexington for over 20 years.

    Represented trust departments of three banks in multiple cases.

    Obtained favorable 501(c)(3) determination letter from Exempt Organizations office for several Kentucky nonprofits.

    Obtained summary judgments for employers in several discrimination cases.

    Successfully defended multiple employees or their new employers in restrictive covenant cases.

    Registered federal trademarks for several restaurants and retail businesses, as well as higher education institutions.

    Closed more than 10 asset purchase/sale transactions ranging from $1-$30 million.

  • Kevin believes in supporting the next generations of both the legal community and his community at large. He served as volunteer Coach for the University of Kentucky College of Law Bankruptcy Moot Court Team for 15 years, and more than six years on the YMCA Metropolitan Board of Directors, including as Treasurer and Finance Committee Chair, and received the Red Triangle Service Award from the YMCA of Central Kentucky. He was the organizing Counsel for the Toyota Bluegrass Miracle League, Inc. and Green Forests Work, Inc., both successful nonprofit organizations making an impact in the region.
